The terms encompass an agreement to engage in arbitration (unless you choose not to). They also encompass a prohibition on collective and representative actions, and they provide non-individualized solutions for all matters, whether presented in court or arbitration. Additionally, there are various restrictions and exclusions, a section specifying the jurisdiction, venue, and governing law for disputes (except where prohibited), and obligations to adhere to relevant laws and regulations.

Guest Policy

Guest Requirements: The guest must be at least 21 years old and possess a valid driver's license. The guest must also provide proof of insurance before renting the vehicle.

Payment: The guest must pay the rental fee in full before receiving the vehicle. The rental fee includes the cost of the vehicle and any additional charges, such as fuel, insurance, or late fees.

Duration of Rental: The rental period begins at the time the guest receives the vehicle and ends at the time the vehicle is returned to the rental location. If the guest wishes to extend the rental period, they must contact the rental company to arrange for an extension.

Use of Vehicle: The guest is responsible for the proper use of the vehicle and must use it in a safe and legal manner. The vehicle cannot be used for any illegal activities or for racing or other high-speed activities.

Return of Vehicle: The guest must return the vehicle to the rental location in the same condition as when it was rented, with a full tank of fuel. Any damage to the vehicle must be reported to the rental company immediately. The guest will be responsible for any damage that occurs while the vehicle is in their possession.

Fuel Level: The guest must return the vehicle with the same level of fuel as it was provided, i.e., a full tank.He is responsible for monitoring and maintaining the fuel level during the rental period.Any deviation from the full tank status upon return will be charged to the Renter according to the current fuel rates.

Insurance: The guest is responsible for providing insurance coverage for the vehicle while it is in their possession. If the guest does not have insurance, they may purchase insurance from the rental company at an additional cost.

Late Return: If the guest returns the vehicle after the rental period has ended, they will be charged a late fee. The late fee will be based on the daily rental rate and will continue to accrue until the vehicle is returned.

Cancellation: If the guest needs to cancel their reservation, they must contact the rental company at least 24 hours in advance. If the rental is cancelled less than 24 hours before the rental period begins, the guest may be charged a cancellation fee.

Additional Drivers: If the guest wishes to allow additional drivers to operate the vehicle, they must provide the additional driver's name and driver's license information to the rental company. Additional drivers may be subject to an additional fee.

Limitation of Liability: The rental company is not responsible for any loss or damage to personal property left in the vehicle during the rental period. The rental company is also not responsible for any injuries or damages that occur as a result of the guest's use of the vehicle.

Additional distance fee: If you exceed the mileage included in your trip, your host can charge you an additional distance fee for each added mile/kilometre driven.

Additional usage: If you’re 30 minutes or more late to return a vehicle, your host can charge you for additional usage.

Claims processing fee: If you or your host files a vehicle damage claim and Renta handles it, we’ll charge you a claims processing fee of up to PHP7,500*. There are no fees if you and your host resolve the claim directly.

Cleaning policy violation fee: If you return the car in a condition that could have only resulted from irresponsible or abusive behavior, we may charge you a violation fee of PHP7,500* plus an additional 3% processing fee. In some circumstances and at our full discretion, we may also remove you from Renta.

Fuel replacement inconvenience fee: If you don’t refuel before returning a vehicle, your host can charge you a PHP 600* convenience fee in addition to their cost to replace the gas.

Gray market policy violation: If you make payment outside of Renta for charges meant to be handled via the platform, we may charge you a PHP 7,500* processing fee plus liquidated damages of PHP275,000* as per our Terms of service.

Guest cancellation fee (outside the free period): If your trip was two days or shorter, we’ll charge you half of one day’s trip price and trip fee. If your trip was longer than two days, we’ll charge you one full day’s trip price and trip fee. If you add delivery, we’ll charge half of any delivery fee.

Guest no-show fee: If your trip is two days or shorter, we’ll charge you 75% of one day’s trip price and trip fee. If your trip is longer than two days, we’ll charge you two days’ trip price and trip fee. If you add pickup/return, we’ll charge half of any pickup/return fee.

Improper return fee: RENTA may charge you a PHP2,500* improper return fee if you fail to respond to requests to return a vehicle, abandon a vehicle, force a trip cancellation, or for other reasons we determine.

Late return fee: If you return a vehicle two hours or more past the trip’s scheduled end time, your host can charge you a PHP 1,500* fee, in addition to the cost of your additional use of the vehicle.

No smoking policy violation fee: Neither you nor your passengers may smoke in any vehicle on RENTA. If your host provides physical evidence of smoking, we’ll charge you a PHP 12,500* violation fee plus an additional 3% process fee and remove you from RENTA.

Processing fee: If a host’s reimbursement issue requires intervention from RENTA, we’ll charge a 3% processing fee.

Service animal and pet policy violation fee: If you return a vehicle with an excessive amount of animal hair or if you transport a pet without permission in a vehicle not labeled as “pet friendly,” your host can charge you a pet cleaning fee of PHP 7,500*.

Chat History Terms and Agreement

This Car Rental Chat History Terms and Agreement ("Agreement") governs the use of chat history on the https://rentaph.com/ website ("Website") and sets forth the terms and conditions between you ("User" or "you") and Rentaph.com ("Company" or "we" or "us") regarding the access, storage, and usage of chat history related to car rental services. By accessing or using the Website's chat services, you agree to be bound by this Agreement.

  2. Privacy and Confidentiality:

    1. Company is committed to maintaining the privacy and confidentiality of User information and chat history. However, User acknowledges that no online communication can be guaranteed as completely secure.
    2. Company will not share Guest's chat history with third parties, except as required by law or as necessary to provide the services.
  3. Data Usage and Analytics:

    1. Company may use aggregated and anonymized chat history data for analytical purposes, such as improving user experience, identifying trends, and enhancing car rental services.
  4. User Responsibilities:

    1. Users are responsible for the accuracy and appropriateness of the information they provide during chat sessions.
    2. Guests are prohibited from sharing sensitive personal information, confidential data, or any content that violates applicable laws or regulations during chat sessions.
  5. Host Responsibilities:

    1. Hosts are responsible for providing accurate and reliable information about car rental services during chat sessions.
  6. Admin Access:

    1. Authorized Company administrators may have access to User chat history, including Guest and Host interactions, for purposes including but not limited to quality assurance, training, and compliance.
  7. Termination and Removal:

    1. Company reserves the right to terminate or suspend access to chat history services at its discretion without prior notice.
    2. Upon termination of services, chat history may be retained by Company for a reasonable period or as required by law.
  8. Modifications:

    1. Company reserves the right to modify or update this Agreement at any time. Users will be notified of any material changes to the Agreement.
  9. Limitation of Liability:

    1. Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of chat history services.
  10. Governing Law:

    1. This Agreement shall be governed by and construed in accordance with the laws of Renta Company Jurisdiction, without regard to its conflicts of law principles.

Hosts Policy

Host Vehicle Responsibility and Safety Guidelines: As a host, you are committed to providing a secure and legally registered vehicle with up-to-date license plates, a clean title (not salvaged or branded), and good mechanical condition. The vehicle must be shared only with guests who are approved drivers listed on the platform. While you can verify a guest's driver's license, you are not permitted to collect additional information or documents, including personal auto insurance. Your listings must be accurate, and you must honor the information and price you've provided. Cancelling bookings to raise prices is prohibited. Any vehicles you offer must be owned by you or authorized for sharing, with any third-party agreements considered. Vehicles subject to leases or loans must comply with those agreements. Only safe, clean, and roadworthy vehicles are allowed, without any illegal modifications. Firearms and weapons should be removed before sharing.

Vehicle Listing Information: When listing vehicles for sharing on Renta, ensure they meet our requirements and that you have the necessary rights to share them for compensation. If your vehicle has tracking or technology devices, follow the tracking and technology device requirements and comply with the law.

Fuel Level : Ensure that the fuel level in the car is sufficient for the renter's needs. We recommend providing the car with a full tank of fuel.

Renta Photography: Renta may provide photographers to capture vehicle images. You're responsible for accurate image use, and Renta owns the rights to these images. Renta can use these images for various purposes, including advertising.

Vehicle Availability: Once booked, you must ensure the vehicle is available as expected. If guests can pick up at a specified location, provide accurate details. Guests should have valid licenses and match the reservation details.

Pricing and Payments: You can set vehicle prices, and Renta will pay you the collected amount, minus fees. If you owe Renta or third-party lenders, Renta may deduct from your earnings. Payment processing services are subject to terms like the Stripe Connected Account Agreement..

Airport Delivery and Regulations: Airport delivery might require permits and fees. Follow airport regulations. Personal vehicle sharing laws might apply to you.

Maintenance and Vehicle Condition: Regularly check your vehicle's condition for safety and roadworthiness. Vehicles must be in compliance with inspections and registration. Damaged vehicles must be addressed promptly.

Reporting Damage: If a guest damages your vehicle, report it within 8 hours.Gather and provide evidence of the damages to RENTA. Cooperation in the investigation is important for coverage eligibility.

Insurance Coverage: Hosts have third-party liability insurance coverage.Hosts are protected by Renta's plans.

Missing Vehicles: If a vehicle goes missing or is stolen during a reservation, contact Renta immediately and cooperate with authorities.

Indemnification: Renta or its insurers will defend and indemnify you for losses during guest use, subject to policy terms.
